Parties: The parties to this contract
are M. Edward & Rochelle Nagel, doing business as (d.b.a)
Redloch Kennel, 6712 Country Lane, Richmond, Texas 77469,
hereinafter referred to as "SELLER," and
___________________ (name),
___________________(address), hereinafter referred to as
"PURCHASER."
Consideration: On payment of the
purchase price of $________________, SELLER will deliver to
PURCHASER's Address at ____________________________________
(Seller's/Purchaser's) expense, one Irish Terrier
______________ (puppy/dog/bitch), age ________ (months/years),
hereinafter referred to as "DOG."
Terms and Conditions:
1. DOG being sold has the call name
"____________________________(DOG's present call
name)," and was formerly known as
"____________________(DOG's previous call name)."
DOG is from American Kennel Club (AKC) litter number
___________________ and is sold with a Breeder's Certificate
of Pedigree and limited AKC registration.
2. PURCHASER understands and agrees that DOG is sold with
the expressed provision that DOG will be registered by SELLER
with the American Kennel Club (AKC) under the "limited
registration" provision of the AKC rules. DOG can not
be shown at AKC sanctioned conformation dog shows and it can
not be bred without first obtaining a change of
registration status to "full registration" from the
SELLER/Breeder. PURCHASER further agrees to spay/neuter DOG
after two years of age if its AKC registration status has not
been changed from "limited" to "full" by
agreement with SELLERS.
3. PURCHASER agrees to incorporate the Kennel
name "REDLOCH" or "REDLOCH'S" in DOG's AKC
registered name.
4. SELLER agrees to comply with all
requirements of AKC with respect to sale and registration of
dogs.
5. SELLER certifies that to the best of
SELLER's knowledge, DOG is healthy and free of hereditary and
genetic health problems that would seriously affect the
animal's enjoyment of life, and SELLER shall provide
appropriate health records at the time of transfer. In the
event any such genetic health problem is confirmed by SELLER's
and PURCHASER's veterinarian within the first year of DOG's
life, PURCHASER shall be entitled to a refund of purchase
price upon returning DOG to SELLER.
6. PURCHASER shall take DOG to his/her
veterinarian within three (3) business days after transfer of
custody to verify DOG's health and to arrange for continuance
of vaccinations and any medications started by SELLER.
PURCHASER shall, within ten (10) business days of transfer,
provide SELLER with a health verification letter signed by
PURCHASER's veterinarian (a copy can be faxed, with the
original sent by mail). Alternatively, PURCHASER may return
DOG to SELLER within ten (10) business days of delivery for a
full refund of purchase price provided DOG has no serious
health problems caused while in care of PURCHASER.
7. If for any reason, other than as set out in
Clause 5 above, PURCHASER can no longer keep DOG after the ten
(10) business days for health verification, SELLER shall be
contacted first before any other arrangements for DOG's care
are made. SELLER will recover DOG at SELLER's cost and take
responsibility for finding it a new home. PURCHASER may not
place DOG in an another living situation (home) without first
obtaining SELLER's written permission.
8. While DOG is owned by PURCHASER, PURCHASER
covenants and agrees to have a veterinarian provide annual
preventative vaccinations and such other medical services a
prudent owner would provide their dog when required throughout
it's life.
9. If DOG is a puppy, SELLER shall assist
PURCHASER with setting (gluing) ears up to age nine months
provided PURCHASER brings DOG to SELLER for such services.
SELLER will provide training and assistance with grooming DOG
when DOG is brought for setting ears during its first nine
months.
10. The parties agree that in the event of any
conflict between any term of this contract and any
requirements imposed by any governmental authority or the
American Kennel Club, the requirements of such governmental
authority or the American Kennel Club shall govern.
11. In the event any provision of this
contract shall be held invalid or unenforceable by a court of
appropriate jurisdiction, the remaining provisions of this
contract shall not be affected thereby and shall be valid and
enforceable to the fullest extent permitted by law.
12. The parties may enforce any term of this
contract through legal action brought in the court of
appropriate jurisdiction in Fort Bend County, Texas. The laws
of the State of Texas shall govern this contract.
